SUBJECT: Legal Update Regarding Safti-Seal Fire-Rated Gasket (FRG)

We are writing you about the recent legal developments concerning KPSI Innovations, Inc., and the Jim Klein family that may impact your usage or purchase of Safti-Seal Fire-Rated Gasket (FRG). Click HERE to download the Legal Update Notice.

UL LISTINGS REMOVED:

  • As of February 28, 2025, ALL UL listings and third-party fire test reports or certifications for Safti-Seal FRG used in head-of-wall joints have been removed from UL’s online listing for certified products and assemblies. This removal was ordered by a Permanent Injunction issued by the Honorable Judge James L. Robart of the United States District Court for the Western District of Washington at Seattle (click HERE to download the injunction).

CEMCO’s PATENT UPHELD BY U.S. PATENT AND TREADEMARK OFFICE:

  • On March 7, 2025 the USPTO concluded a reexamination of CEMCO Patent #7,681,365. The patent was reaffirmed as valid and enforceable, confirming that products such as the Safti-Seal FRG, whether sold previously or in the future, infringe on CEMCO’s intellectual property rights. KPSI, BANKRUPTCY FILING:

  • On April 21, 2025, KPSI Innovations, Inc. filed a petition for Bankruptcy. This is the third entity to dissolve since 2022 involving Jim Klein and his infringing product. Previously, Safti-Seal, Inc., and Seal-4-Safti had ceased operations. All three entities had been subject to judgements for infringement by Federal Court Actions, and this Bankruptcy filing is yet another futile attempt to avoid the judgement of the court.

$3.7 MILLION FEDERAL JUDGEMENT:

  • KPSI, Jim Klein, and Serina Klein were ordered to pay CEMCO $3.7 million for willful patent infringement and fraudulant transfer of Assets (click HERE for the judgement).

Next Steps:

Given these rulings, we advise caution. Confirm UL certifications independently and consult with your own legal counsel before purchasing products from Jim Klein or any new entity that may eventually attempt to circumvent the rulings of multiple federal courts.
